1. Scope
These terms and conditions apply to all consumers and entrepreneurs who order through this online shop. Anyone who processes a private order is a consumer. Anyone who goes through an order for  a commercial purpose or as self-employed concludes a legal transaction as an entrepreneur. For entrepreneurs, the general terms and conditions also apply to future business transactions. Supplementary terms and conditions only apply if express consent has been given.

2. Contractual partner, conclusion of contract
The purchase contract becomes valid with the purchase of art that is by the painter Peter Nottrott. The paintings in the shop are a binding offer from the painter Peter Nottrott for the conclusion of a contract. If consumers and entrepreneurs place one or more products in the shopping cart, this can still be changed and is non-binding. A binding contract is formed the moment the order button is clicked. Immediately thereafter, the consumer / entrepreneur will receive a confirmation of the order by e-mail.
3. Contract language, contract text storage
German or English is used as the contract language. The text of the contract is saved by the painter Peter Nottrott, and entrepreneurs and consumers will receive the order details and general terms and conditions by email.

4. Terms of Delivery
The shipping costs are included in the stated product price as well as VAT in the EU.  In case your country is not in the EU, import fees / taxes for the buyer may apply. 

5. Payment
There are basically several different payment methods available to you in the online shop:
- Payment in advance
When this payment method is selected, the consumer or entrepreneur will receive the sellers bank details in a separate email. The order will be shipped and delivered upon receipt of payment.
- PayPal
If you have chosen the PayPal payment method, you must be registered and authorized there in order to be able to pay the invoice amount. In the ordering process of this online shop, you will be redirected to the website of the online provider PayPal. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment order. You'll get more information during the ordering process.
- credit card paypal
If you have chosen the credit card payment method via paypal, you do not have to be registered in order to be able to pay the invoice amount. The payment transaction will be carried out by your credit card company immediately after confirmation of the payment order and after your legitimation as the legitimate cardholder has been confirmed. Your card will then be debited. You'll get more information during the ordering process.

6. Damage in transit
The following applies to consumers: If obvious transport damage is noted upon delivery, please report such errors to the deliverer as soon as possible and contact us immediately. This will help to assert the claims of the painter Peter Nottrott against the carrier. At best, send photos of the transport damage. The omission of a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. The following applies to entrepreneurs: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the forwarding agent, carrier or other person or institution responsible for carrying out the shipment. The obligation to examine and give notice of defects regulated in Section 377 of the German Commercial Code (HGB) applies to merchants. If you omit the notification regulated there, the goods are deemed to have been approved, unless there is a defect that was not recognizable during the inspection. This does not apply if the painter Peter Nottrott has fraudulently concealed a defect.

7. Warranty and Guarantees
The statutory liability for defects applies. Information on any additional applicable guarantees and their conditions can be found with the product and in the special information pages in the online shop.

8. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/. We are not obliged to participate in a dispute settlement procedure before a consumer arbitration board.

9. Final Provisions
If you are an entrepreneur, then German law applies to the exclusion of the UN Sales Convention. If you are a merchant within the meaning of the Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is the place of business of the painter Peter Nottrott.
